What are the fines and penalties for the most common motor vehicle offenses?

The penalties listed under STATEWIDE VIOLATIONS BUREAU SCHEDULE apply when a court appearance is optional and defendant pleads guilty without a hearing.   • Driving or parking unregistered motor vehicle (N.J.S.A. 39:3-4)
    • STATEWIDE VIOLATIONS BUREAU SCHEDULE: $54.00;
    • MINIMUM MANDATORY FINES & PENALTIES: $0 to $100.00;
    • Failure to register.
    • No person owning or having control over any unregistered vehicle shall permit the same to be parked or to stand on a public highway.
    • Any police officer is authorized to remove any unregistered vehicle from the public highway to a storage space or garage, and the expense involved in such removal and storing of the vehicle shall be borne by the owner of the vehicle, except that the expense shall be borne by the lessee of a leased vehicle.
    • For the misstatement of any fact in the application required to be made to the chief administrator, the person making such statement or omitting the statement that the motor vehicle is to be used as a leased motor vehicle when that is the case shall be shall be subject to a fine of not less than $200.00 or more than $500.00, or imprisonment for not more than 6 months or both, at the discretion of the court. The director shall, upon proper evidence not limited to a conviction, revoke the registration of the motor vehicle or driver’s license of a person who violates this section for a period of not less than 6 months or more than 2 years.

    • “Whenever this section is used as an alternative offense in a plea agreement to any other offense in Title 39 of the Revised Statutes that would result in the assessment of motor vehicle points, the penalty shall be the same as the penalty for a violation of section 1 of P.L.2000, c.75 (C.39:4-97.2), including the surcharge imposed pursuant to subsection f. of that section, and a conviction under this section shall be considered a conviction under section 1 of P.L.2000, c.75 (C.39:4-97.2) for the purpose of determining subsequent enhanced penalties under that section”
    • The operator of a motor vehicle may use a hand-held wireless telephone while driving with one hand on the steering wheel only if:
      • The operator has reason to fear for his life or safety, or believes that a criminal act may be perpetrated against him or another person, OR
      • The operator is using this device to report to appropriate authorities: a fire, traffic crash, serious road hazard, medical or hazardous material emergency, or another motorist who is driving in a reckless, careless or otherwise unsafe manner or who appears to be driving under the influence of alcohol or drugs. A hand-held wireless telephone user’s telephone records or the testimony or written statements from appropriate authorities receiving such calls shall be deemed sufficient evidence of the existence of all lawful calls made under this paragraph.
    • A person who has been convicted of a previous violation of this section need not be charged as a second or subsequent offender in the complaint made against him in order to render him liable to the punishment imposed by this section on a second or subsequent offender, but if the second offense occurs more than 10 years after the first offense, the court shall treat the second conviction as a first offense for sentencing purposes and if a third offense occurs more than 10 years after the second offense, the court shall treat the third conviction as a second offense for sentencing purposes.
  • Speeding (N.J.S.A. 39:4-98) [1 to 14 MPH above limit (2 points); 15 to 29 MPH above limit (4 points); 30 or more MPH above limit (5 points)]

    • NOTE: 20 MPH or more in Safe Corridor or Construction Zone or 65 MPH Area cannot be paid through the Violations Bureau. 40 MPH or more: cannot be paid through the Violations Bureau.
  • Improper turn at traffic light (N.J.S.A. 39:4-115) [3 points]

    • The Director of the Division of Motor Vehicles also may revoke the license to drive a motor vehicle of any person who shall have been guilty of such willful violation of any of the provisions of this act as shall, in the discretion of the director, justify such revocation.
  • Improper passing of frozen dessert truck (N.J.S.A. 39:4-128.4) [4 points]
